Massachusetts' New ADU Law (Effective February 2025)
Massachusetts enacted a major change to its housing policy with the Affordable Homes Act, which took effect on February 2, 2025. This law allows homeowners across the state to build Accessory Dwelling Units (ADUs) “by right”—meaning no special permissions or zoning variances are needed—in single-family residential zoning districts. - Built by Right: Homeowners may now construct an ADU on their property without needing discretionary zoning board approvals, as long as basic state requirements are met. This streamlines the process and removes significant previous barriers.
